Pinner Seeks Post Conviction Relief
A man who was convicted of sexual intercourse without consent on a train in 2015 has filed a petition for post conviction relief in Roosevelt County’s district court.
According to court documents, the victim was traveling across the country with her two sisters in 2015 when sleeper car attendant Charles Henry Pinner entered her room and raped her.
During a hearing in Wolf Point on Wednesday, Nov. 10, a trial date regarding the post conviction relief petition was scheduled for April 20, 2022.
Post conviction relief allows the defendant to bring more evidence or raise additional issues in a case after a judgment has been made.
Pinner is being represented by Colin M. Stephens of the Smith and Stephens law offices in Missoula.
Claims include that counsel was ineffective for not requesting a certain mental state instruction, counsel was ineffective for not requesting instruction to nurse’s testimony, counsel was ineffective for not ensuring that a record was made of the settling of instructions, counsel was ineffective as far as handling another individual’s testimony and that counsel was ineffective for not challenging the admissibility of the victim’s sister’s testimony.
