Baker, Delvalle Appear In District Court
Three hearings were held in district court in front of Judge David Cybulski on Wednesday, July 10.
Frank Hank Baker denied all charges during a revocation hearing. Baker is serving a five-year sentence with the Department of Corrections with two years suspended.
The charges claimed that Baker violated the terms of his conditions by not being at the correct residence; lacking employment and not reporting it to his probation officer; being unreachable since May 17, 2003; substance abuse; and being arrested on partner/ family member assault charges.
Baker denied all the accounts. A hearing was set for Aug. 13.
Roosevelt Deputy County Attorney Thomas Bleicher requested Baker’s bond be increased to $50,000 and, if he is released, adding GPS tracking would be part of the requirements.
Bleicher noted that U.S. Marshals Service needed to assist the Roosevelt County Sheriff’s Office in finding and arresting Baker in November 2023.
“He has an inability to cooperate with law enforcement,” Bleicher said.
Public defender Shannon Sweeney argued that Baker is already in the custody of the Department of Corrections.
“He will not be able to leave anyway,” she said.
Cybulski decided to increase the bond to $50,000 and add the GPS tracking condition just in case.
In another hearing, Ramon David Delvalle of Poplar changed his plea to guilty for failure to register as a sexual or violent offender in Montana.
Delvalle admitted that he arrived in Montana in 2019 and failed to register. A pre-sentencing investigation was ordered.
The change of plea hearing for Theron Richard Hagadone was postponed to Aug. 13, because he was unable to find transportation from Poplar to the courthouse in Wolf Point.
