Judge Hears Petition To Revoke Cases
Several petition to revoke cases were conducted in district court in front of District Judge David Cybulski on Wednesday, Sept. 11.
Trevor Levi Crain changed his plea and admitted to not reporting an instance of failure to comply with the law.
Based on a joint recommendation, Cybulski unsuspended Crain’s 10-year sentence with the Department of Corrections for Crain to receive treatment.
Matthew Lavelle Harris denied four counts of violating his probation including disorderly conduct.
If his sentence is revoked, Harris could face up to 10 years with the Department of Corrections. A hearing is scheduled for Sept. 24.
Justin Ladd Johnson denied a count of violating his probation. If his sentence is revoked, he could face up to five years with the Department of Corrections.
Johnson requested a reduction of his $40,000 bond to being release on his own recognizance. His attorney, Sally Kay Hickok, noted that Johnson has been working for the past year, doing treatment, paying child support and is enrolled in a course to become an addiction counselor. After he found out there was a warrant for him, Johnson drove hours to turn himself in. The state didn’t oppose the request but wants Johnson submitting weekly drug tests.
Maria Del Socorro Hernandez- Archdale made not guilty pleas to criminal possession of dangerous drugs and possession of drug paraphernalia. An omnibus hearing was set for Nov. 13. A trial was scheduled for Jan. 16, 2025.
Joshua Edward Franke made a not guilty plea for criminal possession of dangerous drugs. An omnibus hearing was set for Oct. 16, and a trial was scheduled for Nov. 15. Franke was released on his own recognizance. He must have weekly drug tests and is under house arrest other than working.
Maurice James Gunn made not guilty pleas to driving under the influence of intoxicants, fourth or subsequent offense, and speeding. An omnibus hearing was scheduled for Sept. 24, and a trial was set for Nov. 14.
