Defendants Sentenced During Hearings
Two individuals were sentenced during hearings in district court in front of Judge David J. Cybulski on Wednesday, Dec. 11.
Joshua Edward Franke was sentenced in a revocation hearing. He admitted to violations including having drug paraphernalia and being in the possession of alcohol.
Based on a joint recommendation, Franke was sentenced to five years with the Montana Department of Corrections with one year suspended. He will given credit for 566 days served.
Parker Lee Gray Hawk was sentenced for the charge of criminal possession of dangerous drugs. Gray Hawk received a three-year deferred sentence and wasn’t fined. Both parties recommended the sentence.
Jesse Hank Baker III was read his rights in his petition to revoke hearing. He is currently a prisoner in Yellowstone County. Because Baker didn’t have an attorney, the hearing was moved to Jan. 15, 2025. If found in violation, Baker faces up to a sentence of 11 years and a fine of $50,500.
John David Panasuk’s request for a different Office of Public Defender attorney was granted in his petition to revoke hearing.
Breanna Luv Rahn-Lowe was sentenced after an adjudication hearing was conducted regarding a petition to revoke.
A probation officer from Richland County testified about Rahn-Lowe’s background. Violations included having her whereabouts unknown, being terminated from the treatment court and testing positive for meth when she was in the hospital having a baby.
Defense attorney Sally Kay Hickok recommended that Rahn-Lowe goes into in-patient treatment. Prosecutor Thomas Bleicher argued that Rahn-Lowe be put in prison for eight years.
Cybulski sentenced Rahn-Lowe to eight years with the Montana Department of Corrections with three years suspended. She also received credit for street time served.
Whitley Raquel Arredondo of Williston, N.D., failed to show for her sentencing hearing on Wednesday. After the hearing was rescheduled for Friday, she failed to appear again. An arrest warrant was issued to her. Her sentencing was rescheduled for Jan. 15, 2025.
