TC Energy Seeks Damages Over Keystone Decision
According to news reports, the Alberta government is considering joining TC Energy Corp., in challenging President Joe Biden’s cancellation of the Keystone XL Pipeline.
On July 2, TC Energy announced it will seek $15 billion in damages that the company has suffered as a result of the United States’ breach of its NAFTA obligations.
The case is being filed as a legacy North American Free Trade Agreement Chapter 11 dispute under the United States-Mexico-Canada Agreement.
The Notice of Intent was filed with the U.S. Department of State, Office of the Legal Adviser.
TC Energy announced in June the decision to terminate the Keystone XL Pipeline project.
The project, which aimed to carry oil from the tar sands of Canada into the United States, had its permit revoked by President Biden in January. The project was anticipated to carry about 830,000 barrels of oil sands crude daily to Nebraska.
At that time, U.S. Rep. Matt Rosendale, R-Mont, released the statement, “President Biden owes Montanans an explanation as to why he decided to pull the Keystone XL Pipeline permit. This killed a project that was going to be critical to Montana. The administration has reversed over a decade of planning for our local governments, cut funding for our school systems, and sacrificed the communities that were dependent on revenue from this project to get through the pandemic. We are already seeing the price of Biden’s war on energy independence, and I fear its impact will only get worse.”
