Defendants Deliver Not Guilty Pleas

District judge David J. Cybulski heard a series of not guilty pleas during hearings in district court on Tuesday, Nov. 28.

Joshua Kyle Burks made not guilty pleas to the charges of criminal possession of dangerous drugs and tampering with physical evidence for an incident that occurred on Sept. 7.

An omnibus hearing was scheduled for Jan. 10. A trial was set for Feb. 15.

Theron Richard Hagadone made not guilty pleas to the charges of criminal possession of dangerous drugs, possession of drug paraphernalia, and driving while privilege to do so is suspended or revoked.

Public defender Shannon Sweeney requested a reduction of bail from $25,000. She noted that Hagadone has a job lined up and has family in Poplar.

Deputy county attorney Thomas Bleicher argued that Hagadone has multiple felonies and his record includes a failure to appear in court.

Cybulski reduced Hagadone’s bail to $5,000 and said that the defendant must be restricted to Roosevelt County. Cybulski said he will increase the amount to $100,000 if Hagadone fails to follow the conditions of his release.

Wyatt Blaine Bergie Sr. was scheduled to be sentenced for petition to revoke.

Bleicher said that when Bergie arrived for the hearing, law enforcement smelled alcohol on his breath and Bergie tested positive for alcohol. Cybulski ordered that Bergie be held until a Dec. 15 hearing for breaking his probation.
